Terms and Conditions of Sale

Article 1 — Seller identification

“MOLATTO is a brand operated by MOCRISTO SAS.” These Terms and Conditions of Sale (“T&C”) govern the relationship between MOCRISTO (hereinafter “MOLATTO”, “we”), a simplified joint-stock company (SAS) with share capital of €500, registered with the Paris Trade and Companies Register under number 993 874 841, with registered office at 66 avenue des Champs-Élysées, 75008 Paris, and any natural person of legal age (“you”, “the Client”) wishing to order a MOLATTO product.

Any order implies unreserved acceptance of these T&C.

Article 2 — Purpose and scope

These T&C define the terms of distance selling of MOLATTO products — made-to-measure shoes and shirts, and associated accessories — between MOCRISTO and its clients.

The molatto.com website is a premium showcase and does not offer direct online ordering. Every order is preceded by an in-person appointment with a MOLATTO advisor, allowing selection of the model and finishes and the taking of measurements.

Article 3 — Product characteristics

The products offered are manufactured in Spain in our partner workshop according to artisanal specifications and based on your measurements and choice of finishes. The photographs illustrating the models are indicative; the exact characteristics (colour, patina, finish) are confirmed during the appointment and set out in writing in the quotation.

Article 4 — Ordering process

  1. Initial contact via the website form or WhatsApp.
  2. Appointment at your hotel, office or home: selection, measurements and choice of finishes.
  3. Quotation and written validation by email or WhatsApp.
  4. 50% deposit upon validation. Manufacturing is confirmed once the deposit is received.
  5. Manufacturing within 22 working days in Spain.
  6. Photo of the finished product sent before shipment.
  7. Payment of the balance and shipment with tracking number.
  8. Delivery and post-receipt support.

Article 5 — Prices

The prices displayed on molatto.com are stated in euros, all taxes included (TTC), with French VAT at 20% included. Delivery charges are not included in product prices; they are set out in Article 7 below.

Prices are floor prices (“from”). Crocodile leather variants, exceptional patinas or bespoke finishes are subject to an individual quotation during the appointment.

Invoices issued show the pre-tax price, VAT and the inclusive price separately. For intra-EU B2B sales with a valid VAT number, the reverse-charge mechanism may apply; otherwise, French VAT is charged.

Article 6 — Payment terms

Accepted payment methods are:

  • Cash at the appointment (local clientele).
  • Bank card (France and European Union clientele).
  • Bank transfer (all regions).

The 50% deposit is due upon validation of the quotation. The balance is due before shipment of the product. Failing payment of the balance within 30 days of the finished-product photo, MOCRISTO reserves the right to cancel the order, the deposit remaining definitively retained as compensation.

Article 7 — Delivery

France and European Union

Delivery is free for any order of €150 or more. Below this amount, a flat fee of €15 applies. Shipping is handled by GLS, at a uniform rate across France and the entire European Union.

Express and international

For express delivery or destinations outside the European Union, shipping is handled by FedEx on a quote basis. The rate is provided to the Client at the time of order, depending on the destination and the requested delivery time.

Customs duties and local taxes may apply on arrival depending on the country of destination. These charges are borne solely by the recipient and are independent of MOLATTO.

Delivery times are given for indicative purposes only and may vary depending on carriers and customs procedures.

Article 8 — Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalised.

As MOLATTO shoes and shirts are made-to-measure products created according to your measurements and choice of finishes, no withdrawal is possible once the order has been validated and the deposit paid. This clause is expressly brought to your attention at the time of the appointment and the signing of the quotation.

Article 9 — Warranty

MOLATTO products benefit from the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a defect or non-conformity, you may contact us at contact@molatto.com within a reasonable time following discovery of the defect.

Excluded from the warranty are: normal wear and tear, damage resulting from misuse or improper care, and intentional alterations.

Article 10 — Liability

MOCRISTO’s liability is strictly limited to the amount of the order concerned. MOCRISTO cannot be held liable for indirect damage, loss of opportunity or commercial losses resulting from the use of the products.

Article 11 — Personal data

The processing of your personal data in connection with the order is governed by our privacy policy, to which we invite you to refer.

Article 12 — Disputes and applicable law

These T&C are governed by French law.

In the event of a dispute, you may use the consumer mediation service free of charge, electronically, via the European Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

Failing an amicable resolution, any dispute shall fall under the exclusive jurisdiction of the courts of Paris, save for any mandatory legal provision to the contrary concerning the jurisdiction applicable to consumers.
